By placing an order with us you will be deemed to have read, understood and agreed to these terms and conditions. If you are unhappy with any aspect of these, then you should contact one of our customer service advisers on 0800 032 6413 / theteam@skipsathome.co.uk before placing an order with us. This Contract and your use of our website are governed by English Law and you agree to submit to the exclusive jurisdiction of the English Courts. This does not affect your non-excludable statutory rights.
This website and our Contract have Abeen designed for use within the United Kingdom and under UK law.
Your right to cancel
You may normally cancel your order (once accepted by us) for any reason up to the point of despatch. If you do cancel the Contract within this time any payments made by you will be refunded in full within 30 days.
Payment and Taxes
We accept online payment in a secure environment by most major credit/debit cards. We currently accept . All transactions are shown in £ sterling. All prices quoted on this website are accurate at the time of publication and are quoted in pounds sterling (£) and where appropriate are inclusive of UK sales tax (VAT) at the current rate.
Conditions Relating to the Purchase of Services by You
Skips@Home Ltd will arrange for a skip to be deposited to you in accordance with reasonable instructions provided by you in your order. Please note that despatch estimates are just that. They are not guaranteed dispatch times and should not be relied upon as such.
It is your responsibility to ensure that:
- That a person is available at the delivery premises to sign for delivery and collection of the skip;
- In accordance with current legislation, that the ‘Duty of Care' document that will be provide on collection is signed, detailing the nature of the waste and its transfer to the supplier
- The skip is filled no higher than the top of its sides and in such manner as to prevent spillage of material, both whilst the container is stationary or in transit. All material disposed off by you in a skip provided by Skips@Home Ltd is not harmful and you shall not at any time deposit wet concrete, asbestos or hazardous waste into any skip;
- No cans, bottles or other liquid containers are placed in the skip unless they are dry, free from liquid residues and open for inspection;
- Access to your premises is unimpeded and that you have informed Skips@Home if there is any possibility of an access problem for a skip vehicle.
- No fires are lit in and no corrosive acid or noxious substance, liquid cement or concrete placed in the skip.
- It suffers no damage except fair wear and tear.
- No danger is caused by the skip or its contents to any third party and in particular but without limitation thereto to children.
Skips@Home Ltd reserve the right to debit you with any reasonable charges that might apply if a delivery or collection is aborted for any of the above reasons, or any other reason arising from customer obstruction or misuse or if any costs are incurred in remedying such problems so that a collection can be made, for example providing an extra skip because of overloading or the time and effort spent removing unacceptable contents.
Skips@Home Ltd, its officers, employee, agents and suppliers reserve the right to refuse to collect the skip (without further liability), if in our reasonable opinion, you have created a risk for any person, vehicle, equipment and property. In such cases, if Skips@Home Ltd considers that the risk may be nullified, then we shall make suitable arrangements, the cost of which shall be borne by you.
If harmful consequences occur as a result of the deposit(s) that you have made in the skip, then you shall be liable for all losses, damages, costs and expenses of whatever kind and shall indemnify and keep indemnify Skips@Home Ltd for all losses, damages, costs and expenses that we incur as a result.
The time allowed for depositing or picking up a skip is ten minutes. If the vehicle is kept waiting longer than this after arrival then you shall be liable for reasonable demurrage.
Disclaimer and Limitations of Liability
Skips@Home Ltd does not seek to exclude or limit liability for death or personal injury arising from its negligence or that of its agents or employees or for any fraudulent misrepresentation.
To the fullest extent permitted by law and except as provided above, neither Skips@Home Ltd nor any associated company shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or negligence (whether on the part of Skips@Home, or any of its members, agents, directors, employees or otherwise) for any indirect, special or consequential loss or damage (including but not limited to loss of profits or loss of savings), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, supply of the products/service or their use by you.
The limitations of liability in these conditions shall apply equally for the benefit of Skips@Home Ltd and any other associated company of Skips@Home Ltd as if Skips@Home Ltd included references to each such associated company.
The entire liability of Skips@Home Ltd under or in connection with any contract for any products/service to which these conditions apply shall not exceed the price of the service, except as expressly provided in these conditions.
Except as provided by statute, the Company shall not be liable for any indirect loss, or consequential loss of any kind whatsoever (including, without limitation, loss of profit, market or goodwill), whether such loss is caused by an act, omission or negligence on the part of the Company, its employees, agents, contractors, or otherwise.
Factors Beyond the Control of Skips@Home Ltd
Skips@Home Ltd will not be liable to you or be deemed to be in breach of the contract by reason of any delay by it or its agents, employees or suppliers in performing, or failure to perform, any obligations in relation to the service ordered by you if the delay or failure was due to any cause beyond its reasonable control.
Assignment
Skips@Home Ltd may assign or transfer any of its rights or sub-contract any of its obligations under these terms and conditions to any third party. You may not assign or transfer any of your rights or sub-contract any of your obligations under these terms and conditions except with the specific permission in writing of Skips@Home Ltd.
Third Party Rights
No person who is not party to these Terms and Conditions shall have any right to enforce any terms under the Contract (Rights of Third Parties) Act 1999. Nothing in these conditions is intended nor shall affect any of your statutory rights that may not be legally excluded.
Waiver
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
Indemnity
You agree to fully indemnify, defend and hold us and our officers, directors, employees, agents and suppliers harmless immediately on demand from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Contract by you or any other liabilities arising out of your use of this website or the use by any other person accessing the website using your account and/or personal information.
Severance
If any part of the Contract shall be deemed unlawful or for any reason unenforceable, then that provision shall be deemed to be severable from the Contract and shall not affect the validity and enforceability of any of the remaining provisions of the Contract.
Amendments
No amendment or modification to this Agreement shall be binding unless expressly agreed in writing and signed by an authorised representative of the Company and the reserves the right to alter these terms from time to time, any such alteration shall be notified to you.
